Terms of Service

The short version: measurd is a free, local-first measuring app for iPhone with an optional Pro subscription billed by Apple. Your projects are yours and live on your device. Verify every measurement before you build from it. Be reasonable, and we will be too.

The long version follows and is the one that counts.

01Agreement to these Terms

These Terms of Service (the “Terms”) are a binding agreement between you and Leicht Queens (“measurd”, “we”, “us”). They govern your use of the measurd mobile application for iOS (the “App”), the website at measurd.pro (the “Site”), and any related services we provide (together, the “Service”).

By creating an account, installing the App, or using any part of the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 16 years old to use the Service. If you use the Service on behalf of a company or other organisation, you represent that you have authority to bind that organisation, and “you” includes it.

02The Service

measurd is a local-first field-measurement and floor-plan tool. It lets you sketch wall plans and measure them, photograph a space and draw measurements on the photos, capture distances from a compatible Bluetooth laser measure or enter them by hand, generate wall elevations, and produce measurement reports you can export, share, or send to a third-party system of your choice.

“Local-first” means your projects, photos, measurements, layouts and notes are stored in the App on your device. Core features work without an internet connection. Some optional features — signing in, purchasing a subscription, sending data to a third-party service you configure, and, when available, cloud sync and backup — require a connection and involve third parties, as described in these Terms and the Privacy Policy.

The Service is currently offered on iPhone through Apple’s App Store and TestFlight. We may change, add, or remove features over time as described in Section 11.

03Accounts

Some features require you to sign in. Sign-in is provided through Firebase Authentication using Sign in with Apple or a Google account. You are responsible for the security of the account you sign in with and for everything that happens under it. Tell us promptly at hello@measurd.pro if you believe your account has been used without your permission.

You agree to give us accurate information and to keep it current. We may suspend or terminate accounts that violate these Terms, that we reasonably believe are being used fraudulently, or where required by law.

04Free plan, Pro subscription and trials

Free plan

The App is free to use. The free plan currently allows up to 3 active projects at a time. When you reach the limit you can archive projects; archived projects remain on your device and can be opened, viewed and exported, but not edited until unarchived. We may change free-plan limits with reasonable notice.

measurd Pro

measurd Pro is an optional auto-renewing subscription. At the time of writing, Pro removes the active-project limit. Additional Pro features — including cloud sync and backup between devices — may be added over time and, when we say they are part of Pro, are included in the Pro subscription at no extra charge unless we tell you otherwise before you subscribe or renew.

Current prices are shown in the App and on the Site — at the time of writing, $12.99 per month or $99.99 per year (USD; local prices and taxes may vary). Prices may change; a change applies from your next renewal after we give notice through the App Store or the App.

Billing through Apple

Pro is purchased inside the App and billed to your Apple ID by Apple. Payment is charged when you confirm the purchase (or, for a trial, when the trial ends). The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it any time in your Apple ID account settings; deleting the App does not cancel a subscription. We do not receive or store your payment card details.

Free trial

Where offered, new Pro subscriptions include a 7-day free trial. You will not be charged if you cancel before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription. Trials are administered by Apple and are generally limited to one per Apple ID.

Refunds

Because purchases are processed by Apple, refunds are governed by Apple’s App Store terms and handled by Apple. You can request a refund at reportaproblem.apple.com. To the extent permitted by law, we do not issue refunds directly.

Downgrades

If a Pro subscription lapses, your account returns to the free plan. Nothing is deleted: projects above the free limit are archived automatically and remain viewable and exportable on your device.

05Your content and data

You own the projects, photographs, measurements, layouts, notes, reports and other material you create or upload using the Service (“Your Content”). We claim no ownership of it.

Because the App is local-first, Your Content ordinarily stays on your device. Where a feature you choose to use requires it — for example sending a report to a third-party system you configured, or, when available, cloud sync and backup — you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit and display Your Content solely to provide that feature to you and to comply with law. This licence ends when you delete the content or stop using the feature, except for copies in routine backups that are purged in the ordinary course.

You are responsible for Your Content — including having the right to photograph the spaces you photograph, and for complying with any confidentiality obligations you owe to your customers. Do not use the Service to store or transmit content that is unlawful, infringing, or that you do not have the right to use.

Back up your data. Until cloud sync and backup ships, Your Content exists only on your device (and in any device backups you maintain). Deleting the App, resetting the device, or losing it will delete Your Content, and we cannot recover it. Use the App’s export features to keep copies of anything important.

06Acceptable use

You agree not to, and not to help anyone else to:

  • use the Service in violation of any law or these Terms, or for any fraudulent or harmful purpose;
  • copy, modify, distribute, sell, lease, or create derivative works of the Service, or reverse-engineer or decompile it, except to the extent a licence or applicable law expressly permits;
  • circumvent or attempt to circumvent plan limits, subscription entitlements, or security features;
  • interfere with the operation of the Service or any server, network, or third-party service it relies on;
  • use automated means to access the Service in a way that burdens it or that we have not permitted;
  • upload malicious code, or content that infringes the rights of others.

07Measurements, professional responsibility and hardware

measurd is a tool for recording and organising measurements. It does not replace professional judgment. The accuracy of any measurement depends on the laser device, its calibration, how it is aimed, the surface measured, the photograph, and how you draw and assign values. Manually entered values are only as good as what you type.

You are solely responsible for verifying every measurement before relying on it — including before ordering materials, fabricating, cutting, or installing anything. To the fullest extent permitted by law, we are not liable for errors in measurements, plans, elevations or reports, or for any resulting costs, including re-orders, re-fabrication, rework, delays or lost profits.

The App can receive readings from compatible laser measures over Bluetooth — at the time of writing, certain Bosch GLM models, with support for other manufacturers (such as Leica DISTO) planned. Bosch and GLM are trademarks of Robert Bosch GmbH; Leica and DISTO are trademarks of Leica Geosystems AG. measurd is an independent product; it is not affiliated with, endorsed by, or supported by any laser manufacturer. Compatibility with specific device models or firmware is not guaranteed and may change. Use of a laser device is governed by its manufacturer’s instructions and warranty, not by these Terms.

08Third-party services

The Service works with third-party services that have their own terms and privacy policies, including:

  • Apple — App Store distribution, TestFlight, in-app purchases, Sign in with Apple, and device features such as the camera and Bluetooth;
  • Google Firebase — authentication (Sign in with Apple and Google sign-in are processed through Firebase Authentication);
  • RevenueCat — subscription entitlement management for in-app purchases;
  • Systems you connect yourself — for example a CRM or other destination you configure in the App to receive reports. Data you send there is governed by that provider’s terms, not ours.

We are not responsible for third-party services, and your use of them is at your own risk. If a third-party service changes or becomes unavailable, related features of the Service may be affected.

09Intellectual property

The Service — including the App, the Site, their design, software, text, graphics, and the measurd name and logo — is owned by Leicht Queens or its licensors and is protected by copyright, trademark and other laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on Apple-branded devices that you own or control, as permitted by the App Store’s usage rules, and to use the Site for its intended purpose. All rights not expressly granted are reserved.

If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use them without obligation to you.

10Pre-release and TestFlight builds

We may offer pre-release versions of the App (for example through TestFlight). Pre-release software may contain bugs, may be unstable, may lose data, and may change or be discontinued without notice. It is provided for evaluation, “as is”, and any additional terms shown when you install it also apply. Please back up anything you care about before using a pre-release build.

11Changes to the Service and availability

We are constantly improving the Service and may add, change, or remove features, or discontinue the Service in whole or in part. Where a change materially reduces the functionality of a paid subscription, we will try to give you reasonable notice, and you may cancel through Apple.

Because the App is local-first, its core features do not depend on our servers. Features that do rely on servers — ours or third parties’ — may be interrupted for maintenance or reasons beyond our control. We do not guarantee uninterrupted availability.

12Termination

You may stop using the Service at any time and may delete your account from within the App or by emailing hello@measurd.pro. Deleting the App from your device deletes the content stored in it. Cancelling a subscription is done through your Apple ID settings.

We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including 5, 7, 9, 13–17) will survive.

13Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY OF ANY MEASUREMENT, PLAN, ELEVATION, OR REPORT PRODUCED WITH THE SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LEICHT QUEENS AND ITS OFFICERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, OR FOR THE COST OF SUBSTITUTE GOODS OR SERVICES — INCLUDING COSTS ARISING FROM INCORRECT MEASUREMENTS OR FROM LOSS OF CONTENT STORED ON YOUR DEVICE — HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS (US$50). THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW.

15Indemnity

You will defend, indemnify and hold harmless Leicht Queens and its officers, employees and contractors from and against any claims, damages, losses and expenses (including reasonable legal fees) arising out of or relating to Your Content, your use of the Service, or your breach of these Terms or of applicable law.

16Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws rules. If you have a dispute with us, please contact us first at hello@measurd.pro; most concerns can be resolved informally. Any dispute that cannot be resolved informally will be brought exclusively in the state and federal courts located in New York County, New York, and you and we consent to personal jurisdiction there. Nothing in this section limits any non-waivable consumer rights you have under the laws of the place where you live.

17Additional terms for the App Store

The following applies to the App as distributed through Apple’s App Store or TestFlight and is required by Apple:

  • These Terms are between you and Leicht Queens only, not Apple. Apple is not responsible for the App or its content.
  • Your licence to the App is limited to use on Apple-branded devices you own or control, per the App Store terms.
  • Apple has no obligation to furnish maintenance or support for the App. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the App; to the maximum extent permitted by law, Apple has no other warranty obligation.
  • We, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, and consumer-protection claims, and for the investigation and defence of any third-party claim that the App infringes intellectual-property rights.
  • You represent that you are not located in a country subject to a US government embargo or designated a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18Changes to these Terms and general provisions

We may update these Terms from time to time. If we make material changes we will give notice — for example in the App, on the Site, or by email — before they take effect. Continued use of the Service after the effective date means you accept the updated Terms. The “Effective” date above tells you when the current version took effect.

These Terms, together with the Privacy Policy and any additional terms presented in the App, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
